GARLAND (CBSDFW.COM) – Garland police have made an arrest in a deadly shooting that happened October 1.

Jose Ramon Cruz Jr. was arrested and has been charged with murder.

According to police, shortly after Midnight Monday morning Cruz walked up to three men sitting outside in the 4100 block of Walnut Street. The trio was in the front yard of a house, drinking beer.

Cruz reportedly asked the men if he could buy a beer from them and was declined. The 23-year-old walked away but returned a short time later and again asked if he could buy a beer. Again, he was told no.

One of the three men in the yard, 25-year-old Dinh Ngo, began walking toward Cruz to tell him to leave. It was then that the suspect pulled a gun and shot Ngo. The other men with Ngo were able to grab Cruz and hold him until police arrived.

Dinh Ngo died several hours later at Parkland Hospital.

Cruz is being held in the Dallas County Jail on a $500,000 bond.

Testimony Continues In Murdered Arlington Pastor Trial

FORT WORTH (CBSDFW.COM) - There some startling new revelations during the third day of testimony in Steven Lewayne Nelson’s capital murder trial.  The 25-year-old is accused of murdering Pastor Clint Dobson and critically injuring his ministry assistant, Judy Elliott, last year.

During testimony at the Tarrant County Courthouse on Wednesday jurors were shown surveillance video of the defendant buying items at Sheikh Shoes, a store inside The Parks Mall in Arlington. Receipts later showed Nelson had used Judy Dobson’s stolen credit card. Investigators testified that when they searched Nelson’s residence they found shoes, clothes and receipts from stores at the mall.

There were also a number of revelations during courtroom testimony.

At one point prosecutors brought Tracey Nixon to the stand — who made a surprising admission.

Defense attorney Steve Gordon asked, “You’ve been in a relationship with Steven?” Nixon responded, “Yes.” Prosecutors then asked, “You are prepared to say that you are a man?” and Nixon said, “Yes.”

“You are dressed here in court as a woman, right?” Gordon asked and Nixon said, “Right.” Nixon went on to testify that she and Nelson partied in Dallas the day after the murder.

“Have you ever seen this shirt?” prosecutors asked, holding up a green-colored shirt with the face of Oscar the Grouch on it.“That’s the shirt he wore the night we went out,” Nixon answered.

Nixon said she has had an off and on relationship with Nelson for two years.

Several Arlington police officers involved in Nelson’s arrest
three days after the murder testified the defendant was wearing a unique belt.

“He had on a black belt but it had white squares on it,” Arlington Officer Amy Doyle told the jury. “I remembered it because it was unusual.”

Later the lead investigator on the case, Detective Caleb Blank of the Arlington Police Department, testified pieces of Nelson’s studded belt were found at the crime scene.

“When I saw his belt I saw a full row of just those little white studs [with] four of them missing from the belt,” Blank said. “So, it clearly showed that those pieces came from his belt.”

Blank testified after Nelson’s arrest, police secured a search warrant for Nelsons Arlington apartment.

Blank found shoes, shoe boxes, clothes and receipts from Nelson’s shopping spree at the Park Mall.

“In the downstairs closet I located a pair of Nike black and green Nike air Jordan shoes that appeared to have blood on them,” Blank said.

The extent of Nelson’s defense happened when his attorney’s tried to implicate the defendant’s friend, Anthony Springs, as an accessory to the crime.

Lawyers asked, “Did Anthony Springs have possession of the keys to Miss Elliot’s car?” then asked police to further confirm that Springs also had of Mr. Dobson’s iPhone.

Defense lawyers also got confirmation from police that Springs fingerprints were found on Judy Elliot’s car.

A grand jury did not indict Anthony Springs for the murder of Dobson or attempted murder of Elliott. He is charged with aggravated robbery and remains in jail.

Dobson’s family and friends and members of NorthPointe Church have been at the trial everyday.

Testimony continues Thursday.

DALLAS (AP) - Dallas County District Attorney Craig Watkins says he’ll seek the death penalty in the capital murder case of a 30-year-old man charged with the rape-slaying of a 16-year-old suburban Dallas girl last month.

Authorities say Franklin Davis already was charged with four counts of sexual assault when he took Carrollton high school sophomore Shania Gray from her school. She had been expected to testify against him at his trial on those charges. The Dallas Morning News reports investigators say he posed as another person on Facebook to make contact with her.

Davis was indicted on the murder charge Wednesday. Gray’s body was found along a fork of the Trinity River on Sept. 8. She’d been shot and strangled.

ANNETTA SOUTH (CBSDFW.COM) – Authorities in Parker County said that 17-year-old Jake Evans has been arrested and will be charged with capital murder in connection with the shooting deaths of his 48-year-old mother and 15-year-old sister.

Deputies from the Parker County Sheriff’s Office responded to a 911 call early Thursday, just after midnight, in the 100 block of River Creek Lane, in Annetta South. The caller reportedly identified himself as Jake Evans and told officials that he had just shot his mother, who was later identified as Jamie Evans, and his sister, who was not identified.

“The 911 operator here at our center immediately dispatched the Sheriff’s Office out here and kept the caller on the line for a good 20 minutes while the officers were en route,” Parker County Sheriff Larry Fowler explained.

911: Is there any reason that you were so angry with your mother and your sister?

Caller: Uh, I don’t know. I wasn’t… it’s weird. I wasn’t really angry with them, it just kind of happened. I’ve been kind of, uh, planning on, uh, killing for a while now.

911: The two of them or just anybody?

Caller: Pretty much anybody.

Later in the call Evans described how he shot his family members.

Caller: I told my sister that my mom needed her. She was in her room and she came out of her room, uh, and I, I shot her. She rolled down the stairs and I shot her again. And then I went down and I shot my mom about maybe three or four times.

Caller: I’ll never forget my sister; she came down the stairs and she was screaming and I was telling her that I’m sorry but I told her to just hold still because I was going to make it go away, you know? But she just kept on freaking out. And finally she just fell down and I shot her in the head.

In the conversation with the operator Evans added that he now hates guns and the feeling of killing someone.

Caller: I thought it would be quick, you know? I didn’t want them to feel any pain that’s why I used the gun. It was like everything went wrong.

Evans then went on to tell the operator he was worried what he had done would give him nightmares.  The emergency worker on the phone assured him he would get both medical and psychological help.

Once at the scene, deputies found the two bodies and a cooperative suspect. “He complied with the instructions he was given over the phone by the 911 person here at our center and went out with his hands visible, met with the deputies and was taken into custody,” Fowler said.

The suspect’s father was out of town at the time of the killings, according to authorities.

The teenager told both the 911 dispatcher and arresting deputies that he used a .22-caliber revolver to carry out the murders. According to a police affidavit, upon searching the house, a .22-caliber revolver was found on the kitchen table.

While officials believe that Evans acted alone, saying there is “no evidence implicating additional suspects,” they do not know why the boy killed his family members. “We’re still trying to make sense of it,” Fowler said. “Don’t ask me what a motive is, because I don’t know.”

Parker County officials said that both Jake Evans and his younger sister were home schooled.

The shootings came as a shock to area resident Karen Miller, who said the neighborhood had never seen anything more than the occasional burglary, and certainly nothing this violent.  “I just heard about it,” she said adding, “It gave me goosebumps. So it’s very shocking for me.”

Sheriff Fowler has concerns about Evans mental state.  “The mystery deepens in what this young man is troubled by that would precipitate such an act as this.”

Additional details about the exact injuries and the causes of death fro Jamie Evans and her daughter will not be known until the Tarrant County Medical Examiner’s Office completes a full autopsy.

ALEDO (CBSDFW.COM) - Despite a chilling confession to a 911 operator in which Jake Evans admits to killing his mother and sister, investigators are still no closer to finding a motive.

In the call shortly after the killing Evans is heard telling a 911 operator:
Evans: “I just killed my mom and my sister.‬”

MORE: Sheriff: Parker County Teen Killed Mom & Sister

Police say Evans had shot his mother, Jami Evans, 48, and younger sister, Mallory Evans, in the home they shared in the town of Annetta South, a few miles south of Aledo.

Evans stayed on the phone with the 911 operator until police arrived and surrendered peacefully.

His father was out of town at the time but returned upon hearing the grisly news. Investigators are still have no idea what his motive was.

‪”Whatever the deal is, I mean, we don’t have an answer.  That’s the frustrating part of this. The family doesn’t have an answer,” said Larry Fowler, the Parker County Sheriff.

Evans remains in jail without bond. He is not under suicide watch, but is under very close supervision, said Fowler. Evans has been quiet while locked up and has had no visitors.

“At this point he’s indicated he doesn’t want to meet with anybody, including family,” Fowler said.

Investigators said the teen had no problems with drugs or alcohol and had no history of violence.

“But clearly to me he’s been troubled about something, several somethings, I think, but do I know what that is at this point? No,” Fowler said.

‪Evans and his younger sister, Mallory, had been home schooled by their mother since January. Before that, Evans attended Aledo High School.

“He was quiet, real nice, real humble person, never really talked,” former classmate Aaron Vidrine. “I’m sad for him. I’m confused mainly, like why he did it‬.”

Family members declined to talk on camera. Family told CBS 11 Jami Evans was a well respected teacher and former vice principal and an upstanding citizen in the community.

A prayer service was held at First Baptist Church for anyone mourning.

The murders shocked the small town of Aledo and neighboring Annetta South community. Investigators say even though the suspect surrendered, they may never know what Evan’s motive was.

FORT WORTH (CBSDFW.COM) -Update: 11:30 a.m. The jury has found the defendant – Steven Nelson – guilty of capital murder. More details soon.

***

FORT WORTH (AP) - The defense considers whether to produce more evidence as the capital murder trial of North Texas man moves closer to being handed to the jury.

Testimony resumes Monday in state district court in Fort Worth after Steven Lawayne Nelson testified in his own defense. He denied killing the Rev. Clint Dobson at his Arlington church in March 2011. Rather, he insisted that he remained outside the NorthPointe Baptist Church while two friends went inside and committed the deed.

However, he admitted that he entered the church and stepped around the bodies of the victims, who were still breathing, to steal a laptop computer.

Prosecutors are seeking the death penalty.

FORT WORTH (CBSDFW.COM) – In Fort Worth, jurors heard more damaging testimony about the man they convicted of capital murder Monday for the beating death of an Arlington pastor.  25-year-old Steven Nelson is facing the death penalty.  Prosecutors say Nelson is a dangerous man and will remain a threat to others as long as he lives.

A fellow Tarrant County jail inmate today told jurors that he witnessed Nelson torment another inmate that he believed was mentally challenged.  The inmate, whose name is not being disclosed at the request of Prosecutors, says Nelson used a blanket to hang Jonathan Holden in his cell earlier this year.

“He reached through the bars and wrapped it around his neck, and the boy let him,” said the unnamed inmate.  “He [Nelson] kept asking if the four minutes was up, because that’s how long it took to kill somebody.”

Defense attorneys attempted to discredit the inmate—calling attention to his criminal past, which included convictions for family violence and burglary.  But, the Tarrant County Medical examiner’s office ruled Holden’s death a homicide.

According to the inmate’s testimony, after Holden died, Nelson danced.  “Like the Chuck Berry dance,” said the inmate, skipping across the floor on one leg and playing an air guitar.

Jurors took just over an hour to find Nelson guilty of murdering Pastor Clint Dobson.  Now, they must decide if Nelson should receive the death penalty, or life in prison without parole.  Testimony in the punishment phase of the trial is expected to continue for several more days.

FORT WORTH (CBSDFW.COM) – Steven Lawayne Nelson was sentenced to death today for the murder of Rev. Clint Dobson last year at Arlington’s NorthPointe Baptist Church.

Closing arguments concluded Tuesday morning after defense attorneys rested their case. The jury began deliberations just after 10 AM.

After Nelson was sentenced, he broke a sprinkler head in a holding room near the courtroom and caused flooding. Proceedings were over but some people remained in the courtroom. State District Judge Mike Thomas says Nelson somehow broke a sprinkler head in the holding cell. Water slowly started seeping into the courtroom, so deputies ordered everyone out.

On Monday, defense attorneys called Nelson’s mother and other members of his family to testify to a childhood troubled by attention deficit disorder and dysfunctional relationships.

Jurors had the option of sentencing him to life in prison without parole.

The case involved the 2011 stabbing deaths of Pamela Lykins and Jeffrey Scott Summers of Mart. The bodies of the pair were discovered dumped in a ditch.

Griffith and his now-wife Katherine Walker originally were charged with capital murder.

Walker this month pleaded guilty to aggravated robbery with a deadly weapon and received 30 years in prison. Prosecutors say Walker, who also went to the drag races, stole Summers’ truck.

DALLAS (CBSDFW.COM) – Dallas Police have arrested two teenagers in the murder of a Good Samaritan outside of Sherlock’s Pub and Grill in Dallas on October 18.

Donald Glynn Morrow II was shot and killed when he stepped in while attempting to prevent a robbery from taking place outside of the pub. Police have arrested Tierra Winters, 17, and Justin Jones, 19, for capital murder in the shooting.

According to police, Jones admitted to shooting Morrow during the botched robbery and then hopped into a car waiting for him in front of a nearby Sports Authority that was being driven by Winters.

Dallas Police notified Morrow’s mother this morning about the capture of the accused killer.  “They told me they have them. We’re glad they’re off the street.”

Surveillance video led detectives to Jones.  Wednesday morning police surrounded an area where Jones apparently frequented.

Winters admits to dropping Jones off in front of a nearby Chinese restaurant. Jones then proceeded to walk towards Sherlock’s Pub.  After hearing a gun shot, Winters accelerated towards a sprinting Jones to pick him up.

Jones’ images was captured by nearby video surveillance near the offense location and was identified by three witnesses and Winters.

Police also say that Jones had committed a series of robberies on that same day while Winters was his getaway driver. Investigators were able to track Jones after someone who had committed an earlier burglary with Jones came forward and said Jones had admitted to killing Donald Morrow.

A police report indicates that just four and half hours prior, an aggravated robbery took place in south Dallas in which a 2005 tan-colored Nissan, a phone and cash were taken at gunpoint from a victim. Jones is suspected in this robbery, which was corroborated by another witness who was present.

Zadarian Montgomery is accused of being with Justin Jones on the earlier car-jacking.  According to arrest affidavits, all three have admitted their involvement in the crimes.

The capital murder charge is not the first offense for Jones.  According to the Texas Department of Criminal Justice, Jones has two previous charges, both in Dallas County.  In December of 2011, Jones received a six-month sentence for theft of a person and an additional six-month sentence for the unlawful use of a motor vehicle.

An arrest report shows that Jones was arrested for stealing an iPhone on a DART train at the Akard Station.  He was captured a short time later.

Jones was released on May 21, 2012.

Family Requests Pardon Review For Executed Man

AUSTIN (AP) – The family of a man convicted and executed for an arson murder, based on what scientists now say was faulty evidence, is asking the Board of Pardons and Parole to review the case.

Lawyers for Cameron Todd Willingham’s stepmother and cousins submitted thousands of pages of documents that they say rebuts all of the evidence presented at Willingham’s trial. They are asking the board to issue a posthumous pardon.

State officials are currently reviewing 26 arson cases for possible false convictions based on the same evidence. One wrongfully convicted man has already received a full pardon after officials reviewed largely similar evidence.

Willingham received the death penalty after the state fire marshal testified that the home fire that killed his children was arson. Experts now say the evidence was faulty.

ROCKWALL (CBSDFW.COM) - A Rockwall teenager was found dead in her home on Tuesday evening with multiple stab wounds, according to Rockwall Police. The girl, 15-year-old Surie Baeza, was found in her room by her mother.

Investigators say the girl was not feeling well and had stayed home from school at her Lake Rockwall Estates home. They believe she was killed some time between 7:00 a.m. and 7:00 p.m.

Sergeant Jeff Welch with the Rockwall Police Department says the teenager’s mother came home after work, thinking her daughter was sleeping in her room. After preparing dinner for the evening, the mother went to wake her daughter up, but found her daughter on the floor in a pool of her own blood. The teenager was unresponsive.

“Once the officers got there, a preliminary investigation indicates the 15-year-old had several wounds about her torso, which appeared to be knife wounds,” said Welch.

Baeza was dead when police arrived.

According to Welch, investigators are trying to retrace the teenager’s steps in hope of finding the killer. That starts with interviewing the teen’s close friends and family.

“Investigators are working from her inside circle out to try to understand what she was doing for the day and learn about her life.”

Baeza’s family packed up belongings and left the home with Rockwall Police Wednesday morning. Police have spent the day interviewing them as well.

Baeza was a Freshman at Rockwall Heath High School. She turned 15 Sunday, and was a flute player in the Heath High School band.

Baeza’s boyfriend, Joseph Luu, was as shocked by the news as anyone. “I honestly don’t know who would have done this to her.”

They became boyfriend and girlfriend a month ago. He was at school Tuesday when she stayed home sick. He would not see her alive again.

A memorial will be held for Baeza Thursday night at 6:30 at the Rockwall Lake Estates Community Center. The family says the gathering will be a time of prayer and counseling.

HUNTSVILLE (AP) – Condemned Texas prisoner Mario Swain is to die for the beating, stabbing and strangling of a woman during a break-in at her East Texas home a decade ago.

The 33-year-old Swain faces lethal injection Thursday evening in Huntsville for the slaying of 46-year-old Lola Nixon at her home in Longview.

Swain led police to the woman’s body dumped in the back seat of an abandoned car in a remote part of Gregg County, about 120 miles east of Dallas. Authorities said he had a pattern of attacking women and robbing them, often using a chemical inhalant or stun gun to knock them out.

Police investigating her disappearance learned from a neighbor in Longview about a suspicious truck parked on their street. The truck was tracked to Swain.

Family Sues Parents Of Accused Parker County Murderer

PARKER COUNTY (CBSDFW.COM) – A woman in Parker County is brutally murdered, now a lawsuit has been filed against the parents of the man accused of killing her.

Linda Preston’s throat had been slashed when her husband Patrick found her body last month. Now Preston is suing the parents of suspect Hector Trejo, who were the landlords of house that he, his wife and children lived in.

The lawsuit claims that landlords Juan and Anita Trejo sent their son to do work at the Preston home despite his violent background.

“They knew the long and sorted history of their son, which includes an aggravated robbery, two assaults with bodily injury on family members, [and] multiple drug offenses,” said Attorney Paul Previte, the lawyer representing the Preston family.

Landlords Juan and Anita Trejo apparently had their son doing home repair and contracting work for them, and for several days had him working in the Preston house building a set of stairs.

Hector Trejo is charged with Capital Murder, but Previte says his parents are also liable for not accepting their burden of responsibility. “They didn’t warn her,” he said. “They didn’t do any kind of… they didn’t take any steps to protect her, knowing what he [Hector Trejo] was capable of.”

The 28-year-old accused murderer has a long and violent criminal record. Previte said he can’t fathom how the man’s parents disregarded the safety of so many. “If he’s a vicious dog you certainly wouldn’t take it to a playground and let it lose, and there’s a reason for that.”

While Hector Trejo was at the rental property he allegedly got into an argument with Linda Preston, 47, because she refused to let him use her car.

Hector Trejo is being held without bond in the Parker County Jail.

Community Rallies Behind Murdered Greenville Teen’s Family

GREENVILLE (CBSDFW.COM) – Police say as many as 400 people marched Saturday to show their support for the family of a kidnap-murder victim.

16-year-old Alicia Moore was taken after she left a school bus just a few blocks from her home one week ago Friday.  Her body was found Tuesday in rural Van Zandt County.  On Saturday people from all over Greenville marched in her memory.

“It means a whole lot, it means a whole lot,” said Alica’s mother, Arthea Moore.  She was grateful for a community-wide show of support for her family and her daughter.

“Forget about all the negatives that’s out there just think about the good things about her,” she said. “That she was sweet, quiet, a homebody; she didn’t bother hardly anyone.”

But marchers were bothered by Alicia’s fate.  “The world’s just crazy,” said Camellia Capetillo, who worries there are people who will snatch anyone of any age.

“They need to get the buddy system back where kids are together, said Capetillo. “Somebody knows where somebody’s supposed to be, have somebody there with you. Parents sit out and watch the kids get off the bus regardless of their age.”

On Friday Greenville police released photos showing Alicia leaving her bus in hopes the vehicle behind it can be identified for possible witnesses. On Saturday marchers went to the bus stop, where a shrine for the teen continues to grow.

“This is a march for Alicia; she has a voice through us,” Cedric Fisher told the crowd.

Julianna Castro and her children looked on in silence.  “As a mother of four it’s just nerve-wracking, it’s sickening. And hopefully this will wake a lot of people up.”   She added, “When it happens right there, right in your own community, it’s just an eye-opener.”

Greenville police were out in force for the event; extra people working overtime for crowd control…even as investigators continued their search for whomever murdered Alicia.

While some in Greenville were critical of initial police response, march organizer Rev. Phillip Williams of the St. John’s Missionary Baptist Church says everyone needs to be involved…every day.

“They [police] do as much as they could, but if we help, maybe it can help them better,” Williams said. “You know what I’m saying?   We all try to put the blame on the police, but there are few of them and many of us.”

Even as officers continued to build bridges by teaching kids and teens how to stay safe, the sad fact for Alicia’s family is that there have been no arrests.  “No, there’s no new leads, no news information that we know of,” said Alicia’s mother adding, “Very frustrating.”

HOUSTON (AP) – A woman has been found guilty of murder in the death of one of four children killed in a fire at her home day care in Houston.

A jury found Jessica Tata guilty Tuesday of felony murder in the February 2011 death of 16-month-old Elias Castillo. She faces up to life in prison.

Prosecutors say Tata left the children alone with a pan of oil atop a stove top burner while she went shopping. The fire also injured three other children.

Tata’s attorneys argued that she had tried to save the children and produced an expert witness who said faulty kitchen equipment could have sparked the blaze.

Tata is also charged with felony murder in the other three deaths.
